Terms of Service

1. Who These Terms Apply To

These Terms of Service ("Terms") are a legal agreement between you ("you" or "user") and Roots ("Roots", "we", "our", or "us") governing your use of the Roots website at livewithroots.com, the web app at app.livewithroots.com, and any associated mobile applications (collectively, the "Service").

2. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use Roots. If you are using Roots on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

3. Accounts

To access most features of Roots you must create an account. You agree to:

• Provide accurate and current information (including a valid email address)
• Keep your account credentials secure and not share them with others
• Notify us immediately at support@livewithroots.com if you suspect unauthorized access to your account
• Be responsible for all activity that occurs under your account

We may suspend or terminate accounts that violate these Terms.

4. Subscription Plans & Payment

Roots offers the following plans:

Billing. Paid subscriptions are billed in advance — monthly or annually depending on the plan you select. All prices are in US dollars.

Renewals. Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.

Cancellations. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until then. We do not provide partial-period refunds.

Refunds. We offer a full refund within 7 days of your first paid charge if you are not satisfied. After that period, charges are non-refundable except where required by law. Contact support@livewithroots.com to request a refund.

Price changes. We may change subscription prices with at least 30 days' notice sent to your account email. Continued use after the price change takes effect constitutes acceptance of the new price.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Upload or transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Service or another user's account
• Scrape, crawl, or systematically extract data from the Service without permission
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service for any purpose that is fraudulent, abusive, or harmful to others

6. Your Content

You retain ownership of all content you upload to Roots — including home data, photos, receipts, and notes ("Your Content"). By uploading content, you grant Roots a limited, non-exclusive, royalty-free license to store, process, and display Your Content solely to provide the Service to you.

You represent that you have the rights to upload Your Content and that it does not infringe any third party's intellectual property rights or violate any law.

We do not use Your Content to train AI or machine learning models, and we do not share Your Content with third parties except as described in our Privacy Policy.

7. Our Intellectual Property

Roots and its logos, trademarks, software, and content are owned by or licensed to us and are protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or branding.

We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial home management purposes in accordance with these Terms.

8. Third-Party Services

The Service integrates with third-party providers including Supabase (data storage and authentication), PostHog (analytics), Cloudinary (media), and Google (address lookup). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices of third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

ROI and value estimates provided by Roots are modeled estimates only. They are not appraisals, legal advice, or financial advice. Do not rely on them for real estate transactions, insurance claims, or financial decisions without consulting a qualified professional.

We do not guarantee that the Service will be uninterrupted, error-free, or secure, or that any data will not be lost.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ROOTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ROOTS IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $50.

11. Indemnification

You agree to indemnify, defend, and hold harmless Roots and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, Your Content, or your violation of these Terms.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service ends immediately. Sections 6, 7, 9, 10, 11, and 13 survive termination.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service that cannot be resolved informally will be resolved by binding arbitration administered under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

You and Roots waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Changes to These Terms

We may modify these Terms at any time. When we make material changes, we will notify you by email or by posting a notice in the app at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
